Comment Deadline Set for CFTC Proposed Updates to DCO Regulatory Obligations

Comments on a CFTC proposal to update certain regulations governing derivatives clearing organizations are due by February 13, 2023. The Notice was published in the Federal Register.

As previously covered, the new proposal would (i) update information requirements associated with commingling customer funds and futures and swaps positions in one account; (ii) amend certain reporting requirements under CFTC Reg. 39.18(g) ("System safeguards") relating to exceptional systems-related events; (iii) revise reporting requirements in CFTC Reg. 39.19(c) ("Reporting") and (iv) amend certain staff-delegation provisions in CFTC Reg. 140.94 ("Delegation of authority to the Director of the Division of Swap Dealer and Intermediary Oversight and the Director of the Division of Clearing and Risk").
