Updated Cabinet ERISA Chapter Focuses on Fiduciary Rule

Cadwalader updated the ERISA Chapter of Lofchie's Guide to Broker-Dealer Regulation. The new Chapter, authored by partners James Frazier and Steven Lofchie, addresses the U.S. Department of Labor's new fiduciary rule. The new rule, which became applicable on June 9, 2017, pertains to persons who are fiduciaries due to the provision of investment advice. The updated Chapter also explains the new prohibited transaction exemptions related to the rule, as well as changes to certain existing prohibited transaction exemptions.
