Effective Dates

  • January 25, 2016: Effective date of FDIC final rule that revises certain provisions of its securitization safe harbor rule. The safe harbor rule relates to the treatment of financial assets transferred in connection with a securitization or participation and clarifies requirements concerning the retention of an economic interest in the credit risk of a securitized financial asset. Specifically, the rule affects the credit risk retention regulations adopted under Section 15G of the Securities Exchange Act.
  • January 29, 2016: Effective date of SEC adoption of crowdfunding regulations under Title III of the JOBS Act Instruction 3 to add part 227 and instruction 15 amending Form ID (80 FR 71387).

Comment Deadlines

  • January 19, 2016: CFTC Preliminary Report regarding the swap dealer de minimis exception (see CFTC Staff Releases Preliminary Report on Swap Dealer De Minimis Exception (November 18, 2015)).
  • January 22, 2016: CFTC agency information collection review of the NFA decisions in disciplinary, membership denial, registration and member responsibility actions (80 FR 79865).
  • January 25, 2016: CFTC notice of intent to renew the agency information collection review of confirmation, portfolio reconciliation, portfolio compression and swap trading relationship documentation requirements for swap dealers and major swap participants (80 FR 73731).
  • January 25, 2016: CFTC notice of intent to renew the agency information collection review of conflicts of interest policies and procedures by Futures Commission Merchants and Introducing Brokers (80 FR 73732).
  • January 29, 2016: CFTC notice of intent to renew the agency information collection review of: (i) regulations establishing and governing the duties of swap dealers and major swap participants (80 FR 74766); and (ii) reporting, recordkeeping and daily trading record requirements for swap dealers and major swap participants (80 FR 74768).
  • January 31, 2016: The National Futures Association ("NFA") is requiring forex dealer members to report additional information in the daily Forex Financial Report ("FFR") by adding new line items to the supplementary information section of the monthly 1-FR-FCM (or FOCUS II) filing (NFA Notice I-15-29).
  • January 31, 2016: The Office of the Comptroller of the Currency, the Board of Governors of the Federal Reserve System, the FDIC, the FCA and the FHFA interim final rule that will exempt certain uncleared swaps, and uncleared security-based swaps with counterparties that qualify for an exception or exemption, from clearing under the initial and variation margin requirements promulgated under Dodd Frank Act Sections 731 and 764.
