CFTC Issues Rule Enforcement Reviews of CBOT, CME, NYMEX and COMEX

The CFTC Division of Market Oversight ("DMO") issued three separate rule enforcement reviews of certain designated contract markets ("DCMs"), including the Chicago Board of Trade ("CBOT"), the Chicago Mercantile Exchange ("CME"), the New York Mercantile Exchange ("NYMEX") and the Commodity Exchange, Inc. ("COMEX") (collectively, the "Exchanges").

The reviews assessed compliance with CEA Core Principles for DCMs and related regulations with respect to (i) the CBOT and CME audit trail program, (ii) the NYMEX and COMEX trade practice surveillance program, and (iii) the CBOT, CME, COMEX and NYMEX disciplinary program.

DMO found the Exchanges' respective programs to be in compliance with the core principles and CFTC regulations. However, the reviews identified certain deficiencies in a case where an exchange was not in compliance with a CFTC regulation and had to take corrective action including recommendations to improve the Exchange's compliance program.
