NFA Reminds Registrants of Annual Affirmation Requirement for CPO or CTA Registration Exemptions

NFA reminded registrants that the upcoming annual affirmation deadline for entities claiming exemption from CPO or CTA registration is March 1, 2021. Beginning this affirmation cycle, entities re-affirming exemptions under CFTC Rules 4.13(a)(1), (2), (3), and (5) will be required to attest that they are not subject to any statutory disqualifications under CEA Section 8a(2) ("Registration of Commodity Dealers and Associated Persons; Regulation of Registered Entities") (see previous coverage).

NFA emphasized that an entity's failure to re-affirm an exemption will result in such exemption being withdrawn on March 2, 2021.
