SEC Names New Chief of FCPA Unit

The SEC named Charles Cain as the new Chief of the SEC Enforcement Division's Foreign Corrupt Practices Act ("FCPA") Unit.

The specialized Unit is responsible for national enforcement of the FCPA, focusing on anti-bribery provisions. Mr. Cain served as Acting Chief of the Unit since April 2017. While previously serving as Deputy Chief of the Unit, he co-authored the Resource Guide to the U.S. Foreign Corrupt Practices Act. Mr. Cain has over 15 years of experience investigating FCPA matters with the SEC.

Commentary

The appointment of Mr. Cain, who has been Deputy Chief of the Unit since 2011 and has served as the Acting Chief for the past 6 months, suggests that the SEC will continue its recent approach to FCPA enforcement and that major changes in this area under the new leadership are unlikely.
