Gaming Industry Group Moves to Intervene in CFTC's Suit Against Wisconsin

The American Gaming Association ("AGA") asked a federal court to intervene in a lawsuit that the United States and the CFTC brought against Wisconsin for seeking to apply state law to event contracts.

In United States and Commodity Futures Trading Commission v. State of Wisconsin (see prior coverage) the U.S. and the CFTC sued Wisconsin to block the enforcement of the state's gambling laws against five prediction-market platforms. The association asked to intervene under two parts of Federal Rule of Civil Procedure 24. The AGA argued it has a right to intervene under Rule 24(a)(2) because it has a direct interest in the outcome. In the alternative, the association asked the court to allow it to intervene under Rule 24(b), at the court's discretion. The association attached a proposed answer to the complaint.

The association said that Wisconsin does not oppose the motion to intervene, while the U.S. and the CFTC oppose it.
