House Financial Services Ranking Member Criticizes SCOTUS Rulings

House Financial Services Ranking Member Maxine Waters (D-CA) criticized recent Supreme Court rulings for "significantly weaken[ing] the ability of the federal government to protect our consumers and investors, our housing and financial markets, our food supply, healthcare, and even the air we breathe or the parks we visit." 

In a public statement, Ms. Waters asserted that the Court's ruling in SEC v. Jarkesy "blocks the authority of the SEC and countless other critical government agencies," and that the ruling in Loper Bright Enterprises v. Raimondo "undermined the authority of our government agencies to issue rules that protect our country as our economy and world change." She said that "Democrats will continue to use every tool available to thwart the effects of these harmful, devastating decisions and craft legislation to protect our communities from this type of extremism."

Commentary

Does Ms. Waters criticism work both ways? Should the other party win the election, would Ms. Waters allow President Trump the widest permissible discretion in implementing any new legislation, even where his chosen regulators do not give such legislation the most likely legal reading?
