Energy Metro Desk Article: "Drums along the Potomac" (with Lofchie Comment)

This article discusses the turmoil surrounding CFTC Chairman Gensler's efforts to impose a CFTC-centric version of cross-border rules upon the global financial marketplace, Commissioner Wetjen's proposal to issue "interim final guidance" instead, and Commissioner O'Malia's analysis of the issue. The article summarizes four GOP House bills to amend various aspects of Dodd-Frank and comments on recent speculation concerning the identity of the Administration's choice for the next CFTC chairman, including a very positive description of law school professor and industry expert Ron Filler.

Lofchie Comment: Professor Filler was selected last November to chair the CFTC's Global Market Advisory Committee. Given the ongoing, and seemingly worsening, tensions between the CFTC and non-U.S. regulators, his familiarity with cross-border regulations is something that would benefit the agency. In addition, Professor Filler is an expert on customer asset fund protections, which has been another recent trouble spot for the CFTC. Considering how much work remains to be done at the CFTC in order to put its rules in a form where they are capable of being implemented, there is significant logic to the Senate appointing a CFTC chairman with a long knowledge of the futures industry and derivatives generally.
