Premium Update: Guide Your Understanding on CFIUS

The national security implications of an investment deal should be thoroughly explored at the onset of a potential transaction. Our Committee on Foreign Investment in the United States ("CFIUS") Topic Page can help guide your understanding of the CFIUS review process and possible legal implications.

The referenced media source is missing and needs to be re-embedded.

CFIUS is charged with evaluating proposed transactions that could result in a foreign entity gaining control of a U.S. business to determine the effects of such transactions on U.S. national security. CFIUS has the ability to recommend that the President block a deal or take other appropriate action.

There is a bipartisan reform bill that recently passed the House of Representatives to expand the jurisdiction of CFIUS to include certain foreign transactions involving access to technology, with particular focus on Chinese investment in U.S. businesses. To learn more about the proposed reforms and potential impact on financial entities, please contact Joseph Moreno.
