Comment Deadlines

  • June 1: NASAA-proposed Electronic Initiatives Statement of Policy regarding the use of electronic offering documents and signatures.

  • June 3: FinCEN proposal to amend the definitions of "broker or dealer in securities" and "broker-dealer" under Bank Secrecy Act regulations.

  • June 3: FINRA proposal to amend the By-Laws of FINRA's regulatory subsidiary, FINRA Regulation, Inc., to (i) expand the size of the National Adjudicatory Council ("NAC"), (ii) lengthen the terms of office for future NAC members to four years, and (iii) update ballot-counting and sending processes.

  • June 3: Board of Governors of the Federal Reserve System proposal of rules to establish single-counterparty credit limits for domestic and foreign bank holding companies with $50 billion or more in total consolidated assets.

  • June 13: FINRA proposal to amend Code of Arbitration Procedures to provide that, absent specification to the contrary in an award, when arbitrators order opposing parties to pay damages to each other, the monetary awards shall offset, and the party that owes the larger amount shall pay the net difference.

  • June 15: CFTC proposal to amend the exemption in a March 28, 2013 order of the specified electric energy transactions of six independent system operators and regional transmission organizations by clarifying that such entities are not exempt from the private right of action provision under CEA Section 22.

  • June 15: MSRB proposal to further amend its Amended and Restated Articles of Incorporation.

Effective Dates

  • June 7: DOL final regulation defining who becomes the "fiduciary" of an employee benefit plan under ERISA as a result of giving investment advice to a plan or its participants or beneficiaries.

  • June 9: SEC amendments to the Jumpstart Our Business Startups Act and the Fixing America's Surface Transportation Act that would revise rules related to the thresholds for (i) registration, (ii) the termination of registration and (iii) the suspension of reporting under Securities Exchange Act Section 12(g).
