CFTC Publishes Notice of Intent to Renew Process for Review of Swaps for Mandatory Clearing

The CFTC's issued a notice of intent to renew the collection of certain information about reporting and recordkeeping. The information pertains to the information management requirements for derivatives clearing organizations ("DCOs"). The notice was published in the Federal Register.

To determine whether (i) a DCO that wishes to accept a swap for clearing is eligible to clear the swap and (ii) the swap should be required to be cleared, the CFTC requests comments on the following issues:

  • whether the proposed collection of information is necessary for the proper performance of the functions of the Commission, including whether that information will have a practical use;
  • the accuracy of the Commission's estimate of the burden of the proposed collection of information, including of the validity of the methodology and assumptions used;
  • ways to enhance the quality, usefulness and clarity of the information to be collected; and
  • ways to minimize the burden of the collection of information on those who are expected to respond, including through the use of appropriate automated electronic, mechanical or other technological collection techniques, or other forms of information technology; e.g., permitting the electronic submission of responses.

Comments must be submitted by June 29, 2015.
