NYSE Proposes Wireless Connectivity Services and Fees

The NYSE proposed new fees and charges for providing wireless connectivity services in order to transport selected NYSE and affiliate market data to market participants.

The proposal adds text to the Wireless Fee Schedule in the amount of "a $5,000 non-recurring initial charge for each Wireless Market Data Connection and a monthly recurring charge per connection that would vary depending upon the feed and the location of the connection." Specifically, the proposal would allow market participants to purchase wireless connections from three data centers that are unaffiliated third parties.

Notably, the NYSE stated that it made the current proposal because the SEC claimed the Wireless Market Data Connections are facilities of the NYSE and should be filed as part of its rules. The NYSE contends that the Wireless Market Data Connections are not SEC facilities and, therefore, do not need to be included in the rules.
