CFTC Designates NFA as Recipient of SDR Data
The CFTC authorized the NFA to receive direct electronic access to data maintained in swap data repositories ("SDRs") registered with the CFTC.
In an Order issued February 12, 2016, the CFTC stated that the NFA is required to maintain the confidentiality of all non-public information received through direct electronic access to SDR data and to refer any request for such data to the CFTC. Pursuant to the Order, the NFA is prohibited from disclosing any information regarding the identity of a counterparty to a swap, or such counterparty's clearing member for such swap, that an SDR would be prohibited from disclosing pursuant to CFTC Rule 49.17(f)(2). Additionally, the NFA may not use SDR data obtained for any purpose other than to facilitate the NFA's performance of functions delegated to the NFA by the CFTC, as well as the NFA's performance of its functions as a Registered Futures Association.
