Fitzgerald Comment: On December 23, 2015, the National Stock Exchange, Inc. ("NSX") and FINRA filed a plan with the SEC for the allocation of regulatory responsibilities dated December 22, 2015 ("17d-2 Plan"). The 17d-2 Plan is intended to reduce regulatory duplication for firms that are common members of both NSX and FINRA, in that FINRA would assume certain examination and enforcement responsibilities. Included in the proposed Plan is an exhibit that lists every NSX rule, as well as select federal securities laws, rules and regulations, for which FINRA would bear responsibility under the 17d-2 Plan. The SEC is publishing this notice to solicit comments from interested persons:
