The CFTC issued its agenda for the upcoming Technology Advisory Committee ("TAC") meeting scheduled for June 3, 2014. According to the agenda, the TAC meeting will focus on a number of issues involving high-frequency trading, the CFTC's surveillance program and swap execution facilities. A FINRA proposal to adopt FINRA Rule 2121 ("Fair Prices and Commissions") and Supplementary Material .01 and .02 (relating to mark-ups) was published in the Federal Register. The proposal would adopt current NASD Rule 2440 and Interpretive Material ("IM") 2440-1 and IM-2440-2 as FINRA Rule 2121 and Supplementary Material, without making any substantive changes to the rules. FINRA also proposed to update references and cross-references within the Supplementary Material and other FINRA rules accordingly. Comments on the proposal are due by June 18, 2014. See: 79 FR 30675. The Office of the Comptroller of the Currency issued the "Collective Investment Funds" booklet of the Comptroller's Handbook. This booklet replaces a similarly titled booklet issued in October 2005. The revised booklet provides updated guidance to examiners and bankers on collective investment funds offered to customers of national banks and federal savings associations, explains the risks inherent in such products and services, and provides a framework for managing those risks. The House Financial Services Committee will hold a full committee markup on 13 different bills and matters on May 29, 2014. The bills that are under discussion include H.R. 4387 (the "FSOC Transparency and Accountability Act") and H.R. ____, a bill to place a six-month moratorium on the authority of the Financial Stability Oversight Council to make financial stability determinations. The Managed Funds Association ("MFA") and the AIMA submitted a joint comment letter to the CFTC on its swap data reporting rules. In the letter, the MFA and the AIMA responded to certain questions in the CFTC's comment request aimed at improving and refining the swap data reporting regime for the following reporting issues: confirmation data; valuation data; reporting party status change; bespoke swaps; package transactions; reporting collateral information for consistency with EU rules; and alpha swap reporting of any swap that is executed with the intention that it be cleared.
